An objective and reproducible calculation model to substantiate the maximum number of coffeeshops per municipality — based on demand, catchment area, and standard productivity, instead of historically developed rules of thumb.
In the Netherlands, there is no legally established standard for the number of coffeeshops per municipality. Municipalities often rely on the rule of thumb of one coffeeshop per 15,000–20,000 inhabitants — administratively convenient, but not substantiated by demand or capacity.
Setting a maximum leads to actual scarcity. Established jurisprudence, the VNG (Association of Netherlands Municipalities) guideline on Scarce Permits, and recent coffeeshop rulings indicate that a maximum system must meet the requirements of due care, proportionality, and non-arbitrariness (Article 3:4 of the Algemene wet bestuursrecht (General Administrative Law Act)). A historical number or abstract inhabitant standard is then insufficient.
This calculation model offers municipalities, entrepreneurs, and courts a verifiable framework. In six steps — via size and market classes, scenarios, standard classes, and explicit parameters — the required number of coffeeshops is calculated based on demand (purchase moments) and standard productivity per coffeeshop.
The model builds on previous research by Breuer & Intraval and Ecorys and has been elaborated with calculation examples for, among others, Helmond and Rotterdam. The calculation model was registered on 25-02-2026 via i-DEPOT with the Benelux Office for Intellectual Property under number 157925.
